Whose Responsibility Is It?

Which drains you are responsible for, and when you should call United Utilities

On the 1st October 2011, new Government legislation was introduced which affected the ownership and responsibilities of private drainage. This legislation transferred ownership of private sewers and lateral drains to the statutory undertaker (water company), in the Cheshire area this is United Utilities.

Put simply, whenever you flush the toilet, take a shower or use the dishwasher, the used water disappears round the U-bend and in to the waste water drainage system, via a private drain which serves only you and your property – this is your responsibility to look after. At the point that your drain connects in to a pipe which serves more than one property, or the drain runs beyond your property boundary, the water company then becomes responsible.

So, as a home owner, you are still responsible for any drain serving just your property and within your boundary. If you have a blocked or damaged drain, then it is your responsibility to contact a drainage company such as Suddenstrike Drain Care and to contact your home insurance company, as you may be covered under your buildings insurance policy.

Within Cheshire and parts of the North West United Utilities are responsible for any shared drainage, whether it falls within your boundary or not. In this instance you will need to contact United Utilities to resolve any issues you may be experiencing.

If your property is served by a septic tank, shared or otherwise, this remains as private drainage, and it is the properties’ that use it who are responsible for its up keep. In this instance it is your responsibility to contact a drainage company such as Suddenstrike Drain Care and to contact your home insurance company, as you may be covered under your buildings insurance policy.
